Device Care and Handling Terms and Conditions

1. Device Information

  • Serial Number – Each device is uniquely identified by its serial number, serving as a primary reference for tracking and support.
  • Agent Handling Devices – Only authorized agents are permitted to handle devices. Any unauthorized handling may result in legal action.
  • BVN (Bank Verification Number) – Agents are required to provide their BVN for registration and verification purposes and to maintain transparency in device transactions.
  • NIN (National Identification Number) – Submission of the agent’s NIN is mandatory, aligning with regulatory requirements and ensuring responsible device management.
  • Telephone Number – Agents must provide a valid telephone number for communication purposes and to facilitate swift resolution of any device-related issues.
 
 

2. Device Care

  • Collateral – Devices provided remain the property of the company and are entrusted to agents as collateral. Agents are responsible for their safekeeping and return in the condition received.
  • Handling Guidelines – Agents are obligated to handle devices with care, avoiding physical damage, exposure to extreme conditions, or any form of misuse that may compromise functionality.
  • Warranty and Repairs – Devices are covered by a limited warranty. Any damage resulting from mishandling or unauthorized repairs will void the warranty, and repair costs will be incurred by the agent.
 
 

3. Device Processing Form

  • Completion of Form – Agents are required to fill out the Device Processing Form for each device received. This form includes details such as serial number, agent information, BVN, NIN, and telephone number.
  • Accuracy and Legibility – All information on the Device Processing Form must be accurate, legible, and correspond to the actual state of the device upon receipt.
 
 

4. Accountability and Compliance:

  • Audits and Spot Checks – Regular audits and spot checks may be conducted to ensure compliance with these terms and conditions. Non-compliance may lead to penalties, suspension, or termination of the agreement.
  • Legal Consequences – Any breach of these terms and conditions may result in legal action, including but not limited to compensation for damages, recovery of devices, and termination of the business relationship.

 

By engaging in the handling and processing of devices, agents acknowledge and agree to abide by these terms and conditions. Failure to adhere to these guidelines may result in adverse consequences, as outlined herein.

Agents/Retailer Purchase Terms and Conditions

These terms and conditions outline the agreement between EBS (hereinafter referred to as “the Company”) and retailers who wish to purchase and distribute MTNN products and MoMo services.

Turnaround Time: Agents are expected to achieve sales within One (1) week.

 

  1. Purchase Limits

 

  1. Turnaround time must be 1 week.

  2. The purchase limits and turnaround times for retailers may be subject to change based on their performance and the Company’s policies.

  3. Retailers are required to regularly report their sales performance to the Company and provide necessary sales data.

  4. Retailers who consistently meet or exceed sales targets may be eligible for higher purchase limits and more favorable terms.

 

  1. Compliance and Documentation

 

Retailers must operate within the legal and regulatory framework, including obtaining any required licenses and adhering to data protection regulations. The company will provide the statutory required license which is the NCC License issued to the company.

Retailers are expected to maintain proper records of their sales transactions and customer interactions.

 

  • Ensure compliance with the NCC and NIMC directives and regulations relation to the Business;

  • Shall not represent- itself as an agent of MTN for any purpose; or

  • Shall nor pledge EBS’s or MTN’s credit; or

  • Shall not give any condition or warranty on EBS’s or MTN’s behalf; or

  • Shall not make any representation on EBS or MTN’s behalf; or

  • Shall not commit EBS or MTN to any contract’s or accept’ any order on behalf of EBS or MTN; or

  • Shall not otherwise incur any liability For or on behalf of EBS or MTN.

 

  1. Security Measures

 

To address security concerns, devices used by retailers can be tracked using the BlackBerry tracker implemented by MTNN. This feature enhances the security of the devices and provides an additional layer of protection.

 

  1. Device Damage and Repairs

 

In the event of device damage, our retailers are currently responsible for covering the cost of repairs. However, to support our retailers and maintain the efficiency of our operations, EBS is committed to assisting with the repairs at the MTNN office. This collaborative approach not only minimizes downtime for our retailers but also reinforces our commitment to their success.

 

  1. Termination

 

The Company reserves the right to terminate the retailer agreement if a retailer consistently fails to meet sales targets or violates any terms and conditions.

 

Retailers can also choose to terminate the agreement with the Company, provided they fulfill any pending obligations.

 

These terms and conditions are designed to create a mutually beneficial partnership between the Company and retailers, promoting effective distribution of MTNN products while rewarding high-performing retailers with opportunities for growth. It is important to note that these terms may be adjusted from time to time based on performance and evolving business needs.

Babatunde Atolagbe's Bio

Babatunde Atolagbe is a Software Engineer and Business Development with more than 20 years of Information Technology and Business Consultancy experience. He has held a variety of senior management positions in the IT and telecommunications industries with leading organizations such as Verizon Wireless, AT&T, MTN Nigeria, Autotrader, and the Centre of Disease & Control (CDC). Prior to EBS, Bobby joined MTN Nigeria in 2011 as QA Performance Manager, led the team to deliver leading innovations for performance testing and engineering as part of HP’s suite of performance validation and management products to Develop, Quality Assurance & Testing, Implement, Support & Maintenance of Application systems.

At Verizon Wireless, he was responsible for Quality Assurance and testing, QA Methodology, and quality strategic directions across the entire company. Prior to working at Verizon Wireless, Bobby worked at Bellsouth (AT&T), one of the largest Service Providers in Telecommunications in America. As a final mission, Bobby helped build an offshore engagement with 50 resources providing training, guidance, and mentoring.

Basit Arogundade's Bio

Basit Arogundade is an experienced executive with over 25 years of Technology and Business Leadership experience both in IT and Telecommunications. His in-depth technology and business experience cover a wide variety of functions, including Business & Technology Management, Solution Development & Delivery (OSS/BSS), Telecommunications network standards and protocols, Program Management, and C-Level Engagements.

For 11 years, Basit was responsible for MTNN IT Business Plan, with a specific focus on Enterprise Architecture and Strategic Planning, and the alignment of MTN IT strategy with the overall business plan, global telecommunications, and Technology trends.

Basit brings his entrepreneurial skills and wealth of experience to managing Estuary Business Solutions (EBS) a Business Consulting firm he started in 2013 – he continues to leverage his local and international experience to run EBS, positioning the company in the forefront of value-Adding dynamic & Innovation service development covering almost all business verticals.
